1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the Pique event discovery platform ("Service") operated by Camperdown Strategies ("Pique," "we," "us," or "our"). By accessing or using Pique, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Service Description

Pique is an event discovery and networking platform that helps professionals find, evaluate, and attend industry events more intentionally. The Service includes:

Event browsing with personalized recommendations
Schedule management and event reminders
Attendee networking and proximity matching (opt-in only)
AI-powered event search and recommendations
Community channels and direct messaging
SMS/text message notifications and AI assistant

Features and functionality may change as Pique evolves. We will provide reasonable notice of material changes that affect your use of the Service.

3. Accounts

You must create an account to use Pique. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date. You must be at least 16 years old to use the Service.

You may not share your account credentials with others or allow others to access the Service through your account. If you believe your account has been compromised, notify us immediately at support@gopique.io.

4. Paid Features

Pique may offer both free and paid features. Details about current offerings and pricing are available on our website at gopique.io. If you purchase paid features, the following terms apply:

Subscriptions auto-renew unless cancelled before the end of the current billing period
We will provide at least 30 days' notice before any price changes take effect
Refunds are handled in accordance with our refund policy, available at gopique.io
You may cancel or change your subscription at any time through your account settings

5. SMS/Text Message Program

5.1 Program Description

Pique sends text messages related to event reminders, match notifications, schedule changes, AI search responses, and account verification codes.

5.2 Message Frequency and Rates

Message frequency varies based on your event schedule and platform activity. During active event periods, you may receive 1-10 messages per day. Outside of event periods, message frequency is minimal. Message and data rates may apply. Contact your wireless carrier for details about your text messaging plan.

5.3 Opt-In

By verifying your phone number during account creation or in your account settings, you consent to receive text messages from Pique at the number provided. You may also opt in by texting START to (929) 588-8559.

5.4 Opt-Out

You can stop receiving text messages at any time by:

Disabling SMS in your notification settings at gopique.io
Contacting support@gopique.io

After texting STOP, you will receive a one-time confirmation message. No further messages will be sent unless you opt in again.

5.5 Help and Carrier Support

For help with Pique text messages, text HELP to (929) 588-8559 or email support@gopique.io. Pique text messaging is supported on all major US carriers including AT&T, T-Mobile, and Verizon. Service may not be available on all carrier networks.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Harass, abuse, or threaten other users
Send spam or unsolicited messages through Pique channels or direct messaging
Attempt to access other users' accounts or private information
Scrape, crawl, or use automated tools to collect data from the Service
Reverse engineer, decompile, or disassemble any part of the Service
Impersonate another person or entity
Upload malicious code or interfere with the Service's operation
Circumvent or attempt to circumvent any access restrictions or security measures

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.

7. Content

7.1 Your Content

You retain ownership of content you create on Pique (messages, profile information, notes). By posting content, you grant Pique a non-exclusive, sublicensable, worldwide license to display, distribute, and store your content as necessary to operate and provide the Service. This license ends when you delete your content or your account, except where your content has been shared with others and they have not deleted it.

7.2 Event Data

Event information displayed on Pique is sourced from public event listings, organizer submissions, and automated extraction. While we strive for accuracy, we do not guarantee the completeness or accuracy of event data. Always verify critical details (dates, locations, registration) with the event organizer.

7.3 AI-Generated Content

Pique's AI search assistant and recommendation features provide suggestions based on available event data. AI responses may contain inaccuracies. AI-generated content should not be relied upon as the sole source of information for event planning decisions.

8. Privacy

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you acknowledge that you have read and understand our Privacy Policy. Our Privacy Policy is incorporated by reference into these Terms.

9. Intellectual Property

Pique, the Pique logo, Resonance Scores, and related branding are trademarks of Camperdown Strategies. All content, features, and functionality of the Service (excluding user-generated content) are owned by Camperdown Strategies and are protected by copyright, trademark, and other intellectual property laws.

You may not use our trademarks, logos, or branding without prior written permission. Nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property except as expressly stated.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY EVENT INFORMATION, AI-GENERATED CONTENT, OR USER-GENERATED CONTENT AVAILABLE THROUGH THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPERDOWN STRATEGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Camperdown Strategies and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal claim, you agree to contact us at support@gopique.io and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly and to mutual satisfaction through direct communication.

13.2 Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. If informal resolution is unsuccessful, any disputes shall be resolved in the courts of New York County, New York.

14. Modifications to These Terms

We may update these Terms from time to time. For minor, non-material changes (e.g., clarifications or formatting), we will update the "Last Updated" date at the top of this document.

For material changes that affect your rights or obligations, we will provide at least 30 days' advance notice via email and/or a prominent notice within the Service before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with any material changes, you may delete your account before the effective date.

15. Termination

You may delete your account at any time through your account settings or by contacting support@gopique.io. We may suspend or terminate your account for violation of these Terms. Upon termination:

Your right to use the Service ceases immediately
We will delete or anonymize your personal information in accordance with our Privacy Policy
Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) will continue to apply

16. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Camperdown Strategies regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
